Softenify is a gentle educational mental & emotional wellness space — not a medical, psychological, or therapeutic service provider. Everything available through Softenify is offered for learning, reflection, inspiration, and personal use only.

Every person’s emotional state, nervous system, and life situation are unique. All exercises, reflections, and rituals are used at your own pace, discretion, and responsibility.

By joining, purchasing, downloading, or accessing Softenify, you agree that:

  • You use all materials entirely at your own discretion and risk

  • Softenify does not guarantee outcomes or results

  • Softenify is not responsible for emotional reactions, interpretations, or decisions

  • All materials are for educational purposes only

  • Content is not intended to diagnose, treat, cure, or prevent any condition

1. General Information

These Terms & Conditions (“Terms”) apply to:

  • the Softenify Shopify store (digital goods)

  • the Softenify Circle community

  • all programs, routines, rituals, guides, reflections, digital files, emails, and content

  • all users who browse, purchase, download, join, or interact with Softenify

By using the Platform, you agree to these Terms and the Privacy Policy.

Definitions

  • Platform — the Softenify Shopify store and the Softenify Circle community

  • User / You — any person aged 18 or older using Softenify

  • Materials — all educational content, guides, rituals, reflections, posts

  • Digital Products — ebooks, PDFs, downloadable files

  • Program — Softenify – The 30-Day Light Mind Reset™

  • Program Space — the private, password-protected Circle area where Program materials are delivered

  • Provider / We / Us — Softenify operated by Salegency

You must provide accurate information and maintain secure access to your account.

We may suspend, restrict, or terminate any account at any time for:

  • violations of these Terms

  • unsafe or abusive behavior

  • harmful or unlawful activity

  • misuse of content

  • or at our discretion, to maintain platform and community safety

No refunds are provided for removals due to violations.

2. Shopify Store — Digital Purchases

Softenify may offer:

  • ebooks

  • PDFs

  • digital guides

  • downloadable educational materials

  • limited-time digital bundles

All purchases are for personal use only unless otherwise stated.

We reserve the right to:

  • modify or discontinue products

  • adjust pricing

  • limit quantities

  • correct errors

  • refuse service or orders

Your use of Shopify is also subject to Shopify’s Terms.

3. Digital Products

3.1 Instant Delivery

Digital products are delivered immediately by email or download page.

For the 30-Day Light Mind Reset™, the digital product is considered delivered when the PDF file with access instructions is sent to the email address provided at checkout or made available for download.

3.2 Non-Refundable

All digital products are non-refundable worldwide, including:

  • EU digital content

  • UK digital content

  • U.S. digital goods

  • AU/NZ digital goods

  • Asia digital goods

Once delivered, no refunds, exchanges, or cancellations are permitted, except where mandatory consumer law requires otherwise.

3.3 Personal License Only

You receive a personal, single-user, non-transferable license.

You may not:

  • share

  • resell

  • upload

  • broadcast

  • distribute

  • use for teaching, therapy, coaching, or training

  • use in your own business or content

This protects Softenify’s intellectual property.

4. Circle Memberships & Programs

Softenify offers structured access through Programs delivered via the Circle platform.

4.1 Access

Access may be delivered:

  • instantly

  • manually

  • through automated workflows

  • by email invitation

For the 30-Day Light Mind Reset™:

  • you first receive a PDF file with instructions and a link to create your Program Space account

  • you must create your Program Space account within 72 hours of purchase

  • you must use the same email address used at checkout

If you do not create your account within this time, the Program is considered fully delivered and no refunds are available.

4.2 Duration of Access

Once your Program Space account is created, you receive access to the Program materials and community for at least 30 days from the date of registration.

Softenify may keep the Program Space available longer but is not obligated to provide lifetime or indefinite access.

Closing or modifying the Program Space after the minimum access period does not entitle you to refunds, credits, or compensation.

4.3 Modifications

We may update, restructure, or replace:

  • programs

  • modules

  • rituals

  • space layouts

  • access levels

to improve clarity, safety, and experience.

5. Payments, Billing & Pricing

Payments are processed through:

  • Shopify Payments

  • Stripe

  • PayPal

Prices are displayed in your selected currency.
Taxes are applied according to your jurisdiction.

5.1 Failed or Disputed Payments

If a chargeback or dispute is filed:

  • your access may be immediately suspended

  • chargeback fees may be passed on to you

  • future purchases may be blocked

6. Refund Policy

6.1 Digital Products

All digital products are non-refundable once delivered.

6.2 Community Removals

If you are removed for violating conduct rules:

  • no refunds are issued

  • all access ends immediately

  • future entry may be blocked

7. Educational & Wellness Disclaimer

Softenify is an educational wellness platform, not a:

  • medical provider

  • psychological or psychiatric service

  • therapy platform

  • crisis support service

Content is provided for educational and self-reflection purposes only.

8. No Medical or Psychological Advice

Nothing on the Platform constitutes medical or psychological advice.

If you experience severe emotional distress or mental health concerns, seek support from a qualified professional or emergency services.

9. No Guarantees

Softenify does not guarantee:

  • results

  • improvements

  • timelines

  • emotional outcomes

Terms like lightness, calm, reset, or support describe subjective experience only.

10. Community Conduct & Safety

You agree to:

  • treat others with respect

  • avoid harmful or prescriptive advice

  • avoid presenting yourself as a professional

We may remove content or users at any time to protect the environment.

11. User-Generated Content (UGC)

You retain ownership of your content.

By posting, you grant Softenify a non-exclusive, worldwide, royalty-free license to host and display content within the Platform.

External use always requires explicit written consent.

12. Intellectual Property

All Softenify materials are protected by copyright and intellectual property law.

Unauthorized use may result in termination, takedowns, or legal action.

13. Liability Limitations

To the fullest extent permitted by law, Softenify is not liable for:

  • emotional reactions

  • interpretations of content

  • personal decisions or outcomes

  • platform downtime

  • third-party service failures

Maximum Liability Cap

Total liability is limited to the greater of:

  • €50

  • or the amount paid by you in the previous 12 months

Mandatory consumer protections remain unaffected.

14. Indemnification

You agree to indemnify and hold harmless Softenify from claims arising from:

  • misuse of content

  • violations of these Terms

  • harm caused by your actions or advice

15. Governing Law

  • EU users — Polish law

  • U.S. and international users — Delaware law

Mandatory local consumer protections apply.

16. Arbitration (U.S. Users Only)

U.S. users agree to binding arbitration under AAA Consumer Arbitration Rules.
Class actions are waived where legally permitted.

17. Severability

If any provision is found invalid, the remaining provisions remain in full force.

18. No Waiver

Failure to enforce any provision does not constitute a waiver.

19. Entire Agreement

These Terms constitute the entire agreement between you and Softenify.

20. Updates

We may update these Terms to comply with law or improve clarity.
Continued use constitutes acceptance.
